These Terms of Service ("Terms") govern your use of the Guidecom platform, operated by Guidecom Inc ("Guidecom," "we," "us," or "our"). The platform includes:
By accessing the Website, installing or signing in to the App, or otherwise using any part of the platform, you ("you" or, if you are a merchant, "Merchant") agree to be bound by these Terms. Additional terms may apply to specific features, and those additional terms are incorporated into these Terms by reference.
Guidecom is a guided commerce platform that enables merchants to embed guided product configuration widgets on their online stores. The platform is accessible through our Shopify application and through our standalone merchant dashboard at app.guidecom.io, and provides:

The demo booking experience is powered by Calendly, which is subject to Calendly's own terms of service.
To use the App, you must create a Guidecom account — either by installing the Guidecom Shopify app on an active Shopify store or by signing up for the standalone dashboard at app.guidecom.io. You represent that you are at least 18 years of age and have the authority to bind your organization to these Terms.
You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@guidecom.io if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
If you use Guidecom through the Shopify app, the App requires an active connection to your Shopify store via OAuth. You authorize Guidecom to access your Shopify store data within the permissions (scopes) requested during installation, which include: reading products, inventory, orders, and themes, and managing discounts. You may revoke this access at any time by uninstalling the App.
If you use the standalone dashboard at app.guidecom.io, you are responsible for providing the product catalog and configuration data you wish to use through the dashboard, and for ensuring you have the rights to upload and use that data.
Guidecom offers subscription plans with varying feature limits, including limits on the number of products, categories, compatibility rules, and analytics data retention. Current plan details and pricing are available within the App.
New merchants receive a 14-day free trial. During the trial, you have access to all features of the selected plan. At the end of the trial, you must subscribe to a paid plan to continue using the service.
For merchants using the Shopify app, billing is processed exclusively through the Shopify Billing API. Charges appear in your Shopify admin charge history, and we do not collect or store your payment method details. For merchants using the standalone dashboard, billing is processed by our third-party payment provider, and payment method details are collected and stored directly by that provider rather than by us. You may upgrade or downgrade your plan at any time through the App without contacting support.
Each plan includes limits on resources. If you exceed your plan limits, certain features may be restricted until you upgrade or reduce usage. We will provide clear notice when you approach or reach plan limits.

The Guidecom platform — including the Website, the App, the Widget, and all associated software, design, documentation, and trademarks — is the property of Guidecom Inc. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App and Widget for your business purposes during the term of your subscription.
You retain all rights to your content, including product data, compatibility rules, categories, widget configurations, and analytics data. You grant us a limited license to host, process, and display your content solely to provide the service to you.
If you provide us with feedback, suggestions, or ideas, we may use them without obligation or compensation to you.
Our collection and use of data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, App, or Widget, you acknowledge that you have read and agree to our Privacy Policy.
You are responsible for ensuring that your use of the App, including the widget displayed on your storefront, complies with applicable privacy laws and your own store's privacy policy. If you collect personal information from your customers, you must disclose the use of third-party services including Guidecom in your privacy policy.
We strive to maintain high availability of the Website and App but do not guarantee uninterrupted service. The Website and App are hosted on Vercel's infrastructure, and availability is subject to their platform reliability. We will make reasonable efforts to notify merchants of planned maintenance that affects the App.
We reserve the right to modify, suspend, or discontinue any feature of the Website, App, or Widget at any time. For material changes that affect paying customers' use of the App, we will provide at least 30 days' notice through the App.
To the maximum extent permitted by law, Guidecom Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Website, App, or Widget.
Our total aggregate liability for all claims arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
The Website, App, and Widget are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify and hold harmless Guidecom Inc, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Website, App, or Widget; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content you submit through the platform.
Shopify merchants may terminate their use of the App at any time by uninstalling it from their Shopify store. Standalone dashboard merchants may terminate by cancelling their subscription and requesting account closure at support@guidecom.io. Upon termination, your access tokens (where applicable) are immediately revoked and your subscription is cancelled.
We may suspend or terminate your access to the App if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees. We will provide notice and an opportunity to cure non-material breaches when reasonable.
Upon termination, your access to the App ceases immediately. For Shopify merchants, data is retained for 48 hours following uninstallation to allow for reinstallation, and is then permanently deleted in accordance with Shopify's data protection requirements. For standalone dashboard merchants, data is permanently deleted within 30 days of account closure. Retention of all other data is governed by our Privacy Policy.
Any disputes arising from these Terms shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Guidecom regarding the App.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
We may update these Terms from time to time. If we make material changes, we will notify merchants through the Guidecom dashboard and update the published version on guidecom.io at least 30 days before the changes take effect. Continued use of the Website, App, or Widget after the effective date constitutes acceptance of the revised Terms.
